TERMS & CONDITIONS OF RENTAL

These pages provide our standard terms and conditions of rental as Owner to the person named on the invoice ("the Guest") who must be over 21 and who is deemed responsible for informing all members of the party about all matters relating to the holiday.

E-MAIL BOOKINGS

We will provide a written quotation by e-mail showing total rental fee to the Guest for the property. Quotations are valid for 14 days, unless and until the property is either booked by a third party, or we receive a deposit for the same dates from any party. Where the Guest agrees by e-mail or other written device to book the property, we will provide a booking confirmation to the Guest by e-mail. Until such time as the Guest has paid the requested deposit or payment as defined on the provisional booking confirmation, we reserve the right to accept any booking for the property from a third party, where said third party agrees to payment prior to receipt of payment from the Guest.

CONTRACT

Following clearance of the funds to our bank account, we will issue a rental invoice by e-mail or postal mail to the Guest at which time a binding contract will come into existence. The contract is made with the person named on the invoice ("the Guest" or you), who must be over 21 and who is deemed responsible for informing all members of the party about all matters relating to the holiday.

   

PAYMENT

The Guest agrees to pay the full invoice value within the due dates set out in the booking confirmation. The invoice will detail the total cost of the accommodation, the deposit due, the tax payable due and payment due dates.

Final and full payment is due 60 days prior to arrival at the villa. If it is not paid on time we reserve the right to cancel the booking, retain the deposit and apply cancellation charges as described below.

Payment may be made in either Pounds Sterling or United States dollars.

CANCELLATION

Any cancellation must be notified to us in writing (this includes e-mail) by the person who has contracted the holiday. If such notification is received more than 60 days before the holiday commencement date, only the deposit will be retained by us. Otherwise, the following charges apply: 30-60 days before, 50%; 30 days before, 75%; 14 days or less, 100%.

We regret that we are unable to waive any of the cancellation charges above, whatever the circumstances.

Please note that we strongly recommend that all members of the holiday party obtain appropriate travel and personal insurance cover.

BASIS OF RENTAL

Our property is offered for short-term rental on a self-catering basis. Complimentary starter soap, toilet paper and trash bags are provided, but once these items are used it is the Guest's responsibility to replenish them.

RESPONSIBILITIES

The Guest is responsible for any property occupied and is expected to take reasonable care of it and to leave it in a clean and tidy condition. Any damages are the responsibility of the Guest, and their cost shall be refundable on demand. Arrival at the villa is after 4 pm; departure is by 10 am, to allow for preparation for the changeover of guests. All keys must be returned to the offices of our Managing Agent (Villa Direct) by 11 am on the day of departure.

 

Added to the rental cost set out in the Invoice is an amount paid as an Accidental Damage Waiver (ADW) premium to the Owner. The Guest agrees that the Party Leader remains responsible for all loss from the property or it inventory during the period of rental. The Guest must complete and return the Registration Form (provided on arrival) within one working day to protect their ADW from claims made as a result of accidental damage found during their stay, or within 72 hours following their departure, up to a maximum value of $300 (or sterling equivalent).

MANAGING AGENT

In the event that the Guest has a problem whilst in the property, he or she should contact our managing agent, Villa Direct (www.villadirect.com). Tel: 407 397 1210 (24 hours).

Villa Direct agrees to provide a maximum 4 hour response to remedy problems, that, at the sole discretion of Villa Direct, constitute emergencies which would affect the safety of Guests.

LIABILITY

We cannot be held liable to accept responsibility for death, bodily injury, loss of goods or illness whilst in the accommodation.

We do not accept liability for failure of pool heat to provide adequate heating where pool heat is provided via an electrical heat pump, and where the outside air temperature drops below 55 degrees Fahrenheit. Electric heating pumps do not operate effectively below this temperature, and failure of such devices to heat the pool is outside of our control, and is regarded as an act of nature.

The Owner does not accept liability for acts of violence, nature, fire, flood, war, civil disobedience, riot or other force majeure that may have a deleterious effect on a Guest.

LAW & JURISDICTION

This contract is governed by the law of England and Wales and the jurisdiction of the English and Welsh Courts. No one has the authority orally to vary these terms and conditions or enter into any verbal agreements with the Guest.

 

Las Palmas Villa is a no smoking villa.

We are sorry we cannot allow pets in Las Palmas Villa.
